Getting Divorce while on a green card
#1
Hi Guys,
Got married in January to my American wife, i'm on a K1-Visa Green card. Unfortunately things have not gone to plan and we are on the verge of seperating. My question is where does that leave me, if we split, do i lose my Green Card status therefore have to leave the States or is there other issues.
Thanks

Do you already have the greencard?
If so, you get divorced, once that's final, you file to remove conditions on your greencard. It means you'll have the 5 years instead of the 3 years requirement before applying for US citizenship, in a gist.

The term you want to research is "Filing to remove conditions with waiver" or "Filing I-751 with waiver".

FWIW, adjustment from a K-1 is somewhat different that normal admission or adjustment.
