Filing I-485 Adjustment of Status

Default Filing I-485 Adjustment of Status

can anyone please tell me if a K-3 visa holder has to file I-485 right
after he/she enters the USA or he/she has to wait until his/her I-130
is approved? Also, the INS website has 3 different I-485 forms. Which
one is for K-3 visa holders? Thanks much.

claudia13839 is an unknown quantity at this point

A person that enters the US on a K3 Visa does not have to file AOS right away. They have 2 years to do so.

Also, in order to file for AOS, the I-130 does not need to be approved. The approval notice of the I-129F would be sent.

October 1, 2002: I-130 sent to VSC
October 8, 2002: 1st NOA for I-130 (recieved 10/15/02)
October 21, 2002: Sent I-129F for K3
October 24, 2002: 1st NOA for K3 (recieved 10/28/02)
January 29, 2003: Faxed Congress Rep. regarding delay
January 30, 2003: Faxed my Senator H. Clinton regarding delay"


As for what I-485 form to use THERE IS ONLY ONE I-485 form. The others are SUPPLEMENTS and not for your use as per the description along side of them on the INS site.

Also in addition to Claudia's response, you might want to consider doing a Consular adjustment when the I-130 is approved rather than filing the I-485 from within the US.

consular adjustment and how is it different from filing the I-485 from
within the US? Thanks much.

Instead of filing a I-485 in the United States, you can wait for your
spouse's I-130 to be approved and arrive in the US as an immigrant,
instead of as a non-immigrant.
