Filing I-129F while Canadian fiance in US temporarily on visitor visa

Default Filing I-129F while Canadian fiance in US temporarily on visitor visa

We will be filing I-129F application for K1 fiance visa soon and ideally
would like to file it while I am visiting in Boston next month. I will be
returning to Canada, have a return flight booked and have a full time job in
Canada, apartment, etc. to come back to.

My questions:

Are we permitted to file an I-129F while I am in the US temporarily? If
this is a grey area, we don't want to jeopardize our application. Are we
better off to wait until I come back to Canada and then file?

AND

If we can file while I am in the US visiting, what do we put for question 13
"If your fiance(e) is currently in the US, complete the following .... etc.
etc. Obviously I arrived as a visitor, but what would we put for
Arrival/Departure Record where it says "Date Authorized Stay expired as
shown on Form I-94." Is this the date I leave the US? This date would be
several weeks after we file the I-129 since I am staying for 5 weeks.

You can file while you are in the US, there is nothing to prevent this.

See if you can wiggle in a small notation, "no I-94, Canadian visitor"

I'm equally curious, because I will be doing the same thing... but my
stay is only 1 week.

Help? Anyone? Rete?

It is as US Ticket said, if you don't get an I-94 when entering the US, then put down "Canadian, no I-94 issued" and you can put in your intended date of departure.

I found when I flew into Ottawa, I got an I-94 in my passport. If I drove, I didn't. So go with what you are given upon entry.
