effects of divorce on K-1 process?

Default effects of divorce on K-1 process?

I'm planning to file the I-129 once my divorce is finalised. My fiancee and
I (it seems odd to have a fiancee while I'm still technically married to
someone else) have met and will present plenty of evidence of a relationship
going back 5 years. My question is: will a recent divorce (subsequent to
the meetings with my intended) trigger alarm bells for the immigration
people, or will they be satisfied when I present a valid divorce decree as
proof that I am able to marry?

You will be fine with a valid divorce decree - plenty of people have
relationships with other people while still married - though estranged.
Shouldn't be a problem.

LOL I am in same boat as you I just wish I could have filed for K-1 while
waiting for final on divorce would have made time go a lot faster since it
took 18 months for divorce.

I just got divorced on Sept 9 and sent my I-129f application the very
next day. I think that the Service Centers don't look too much into
this, they just care that you have a divorce decree. Now the
consulates are a whole different story, they might question you more
at the interview. I think that's what will happen in my case,
especially since it's through Santo Domingo.

My fiance and I both had to wait for our final divorces before we could file our I-129F (although we were both already separated). UK divorces take longer than US ones, and just a few days after my decree absolute, we filed our petition. We were approved just fine - our RFE was only because the photocopy of his decree was not very clear, so he had to send a clearer certified copy.

You will have no problems. Just make sure your divorces are finalized and you have the official decrees. My fiance had to wait until her divorce was finalized before we applied for a k1 and we were approved. If not and you file too early you will run into the same problem that Cute Nurse did which you can read about on todays post.

attack friendly people. I am a liar and I cant read
