EAD Renewal, unusual situation

Default EAD Renewal, unusual situation

Hello,

I have a very special EAD renewal problem and would
like to know if anyone in this group had experienced
before. I would also appreciate if someone can give
me an advice as what to do.

On November 11, 2002, we (Myself, my spouse and my
child) received our new EAD cards. However my EAD
card and my spouse's EAD card were wrong, i.e.,
my photo was printed on my spouse's card and vice versa.

I called INS Vermont service center and the officer told me
to mail the original cards back, attach a note explaining
what went wrong and two photos. I mail the cards back as
instructed. According to FedEx tracking, they received
them on November 15, 2002.

A week ago, I called them back again. The officer told me
my file is under an officer's desk. She also took my FedEx
tracking number, my phone number and my name and told
me that officer might call me if needed. When asked how
to track this process, she said just call back after 2 to 3 weeks.

Now, it is 1/18/2003, I did not hear anything from them.
I don't think I can walk in to INS local office to require
an interim EAD card, do I? Also, given the current
processing speed, my EB2 I485 (December 2001 RD)
will not be processed in the near future. Furthermore,
I do not have a method of tracking this process because
I was not given a case number.

What can I do? I would appreciate any advice you can
give me.

Actually, you can walk into a local INS office and ask for an interim EAD.
They are *supposed* to give it to you as long as it has been 90 days since
you first applied. Unfortunately, some local INS offices ignore that.

As for the case number, try the same one as the original case number.

Also, it may be a good idea to contact your Congressional Representative
for help.

It is my understanding that an interim EAD will be issued only if the
original EAD application, the I-765, has been pending for over 90 and *has
not been approved.* So this probably will not work.

Another thing you can do is to apply for a replacement EAD, with a new I-765
and new fee, and the employer should accept the receipt notice to authorize
your employment for a period of time. This works because it would be a
receipt for replacement of a document *that was already approved,* which in
itself would have authorized your employment.

Yes, that is what you should do.
