It appears from my own experience as well as many others, NYC is not
rendering a decision on I-765 applications within 90 days as required
under 8 CFR 274a.13(d) any longer in many, many cases.
They are also not allowing walk-ins to get an interim EAD at provided
for under the regulations; instead they are requiring status inquiry
ticket vouchers to be used to enter the EAU room, which are limited to
50/day for all case-specific immigration status inquiry purposes.
One of the new features of Department of Homeland Securty, Bureau of
Citizenship and Immigration Services is employee discipline and
discipline demonstration projects. Here, we have a situation in the
NYC EAU where employee are violating the regulations as they have been
doing in the past with no concern whatsoever.
What do to?
Write a complaint and demand a formal investigation into the NYC EAU's
operating and processing procedures, perhaps citing the regulation
violation I mentioned above. You may use Form I-847, but it is not
required.
Mail the complaint by certified mail, return receipt requested, as
follows:

425 I STREET, N.W.
WASHINGTON, D.C. 20536-0001
