Double filing of I-130
My husband, who is a US citizen, filed a spousal petition for me. We
have submitted the I-130 application to the Nebraska office. We have
submitted the application on Aug. 2003 and we're still awaiting
approval as of this date. The inquiry for status online said that that
kind of petition takes about 515 days from date of receipt as opposed
to the projected 300 something days they mentioned in the receipt we
got. I read in one of the I130 help websites that we should file the
petition to the local office and the process will be much much
quicker. My question is this.. Is it worth filing another I-130 to
the local immigration office? I don't care if we spend another $130. I
just want to make sure that it will not cause any future problem with
me filing two I130s. Any help/input would be greatly appreciated.

Neither the status online time estimate nor the I-797 time estimate have any meaning.
What process is it that you think would go faster by filing another I-130 at your local office? I can think of two possibilities, and could probably guess right if I picked one, but it would be best if you stated yourself what your objective is for doing this.

Thanks so much for replying to my post. My husband went over to the
local INS and was told that it will take over a year for our I130 to
be approved through the Service Center BUT if we have submitted it to
that local office (local office just started processing petitions this
fall), it will take no time for the petition to be processed (as in
three months time!). The thing is I am in New York on a H1B visa good
until latter part of 2005. My husband lives in Granite City, IL which
is very close to St. Louis, MO. I am moving there in June and when I
do, I am abandoning my H1B petition. Without a working permit, I can't
get a job. I don't want to be out of a job, that's the thing. I guess
I can work off the books also but I don't want to do anything
illegal... Also, I just want to make sure that we wont get penalized
for double filing I130. Ofcourse, we will send them a letter
requesting for cancellation providing the one filed in the local
office will get approved first... Hope I made sense...thanks again.

I don't know the answer to your question but I just wanted to share what I was told by 2 USCIS officers in Denver.
I told her If I could file a separate I-130 (My Other I-130 is going thru Nebraska), she said no, I said I though I would file another I-130 because.. It is just taking forever for Nebraska to approve an I-130, she then said Don't you worry, Submit AOS thru this office, It is usually taking 6 months to get an AOS interview, I said.. I know but if my I-130 isn't approved I can't be called for an interview, she said.. No Mrs, If we call you for an AOS interview, Nebraska has to approve Your I-130. I couldn't believe what my ears were hearing, I went to the USCIS office 4 days ago again and asked a different USCIS officer and to my surprise he confirmed it!

advance parole, medical stuff, fingerprint stuff) but the Nebraska
office sent the rest back and kept the I130 and we were advised to
file everything once the I-130 was approved. That's why I am also
being wary about the Nebraska filing compared to the District Office
filing...

Please correct me if I am wrong.
Shouldn't you have filed all the applications to your local INS office in the first place, not to the national service center, unless you live in Baltimore area? I mean you could, but then it will take a lot longer because you have to wait until I-130 is approved. If I were you, I would request to void your I-130 at NSC and restart with your local office. Because local office will process I-130 and I-485 at the same time. I was on H-1 B and I went through what you are going through. But it was a while ago, so my memory could be wrong.
