Hi Guys,

My wife will be in the UK on a Spousal visa and i am a UK citizen. We are excersizing EU treaty Rights in Ireland but have been rejected for Residency.

Do we qualify for Direct consular filing?

If not doe someone have a link to the uscis list of service centers.

Doesn't sound like it. Your wife has to have indefinite leave to remain (ILR) in the UK to be eligible for DCF. Having just a spousal visa doesn't cut it, unfortunately.

If not doe someone have a link to the uscis list of service centers.

Jenny, this is no longer true. I just found out recently myself. ILR is now not a requirement for DCF. The requirement now is that the USC must have been living in the UK for at least 6 months, and can then be eligible for DCF. Check recent posts by meauxna...she's been spreading the word around.

To the OP - once your USC wife and you have lived in the UK for more than 6 months, you can do DCF in London.

A USC must be genuinely resident abroad for at least 6 months in order to qualify to file I-130 at a Consulate or USCIS Field Office. Please see the CIS website news announcements (news room link) for the most current information, or see the website for the Consulate where you intend to file.

I don't know what your rejection has to do with any of that, but all the info you need is at uscis.gov--look to the links on the left for the Field Office and drill down to Service Centers. The search box on the top right corner isn't half bad either.
