Divorce/Seperation before AOS interview
This is my situation;
I am a UK citizen married to my USC wife for 3 years. We arrived in
the USA in September of 2002. Before then we had been living together
in the UK. I have filed for AOS, as I entered on a tourist visa. I
have a 1 year EAD card, and a SSN.
Recently, our marriage has been turning sour, we just dont get along
anymore. We tried a trial seperation, and I went to stay with some
friends for a little while in MI, while she stayed in UT. I am now
back in UT, hoping things would improve between us, but they havent.
We are both in agreement that a more permanent seperation is in order.
My question is, if we are not living together, or even worse,
divorced when it is time for my AOS interview, how will that affect
things?

You will probably be denied.

This is a complicated area of the law. You will have to consult with EXPERIENCED immigration counsel on this one.

Too bad you didn't file DCF in London as you'd been residing in the UK
together. Depending on how long your marriage had been by the time of your
interview, you could have had a 10 year GC or in the very least a 2 year
conditional card and not need to worry about AOS or how a divorce would
effect you.
Well Patrick, here is a case where entering on a tourist visa definitely was
a huge mistake eh?
(is feeling a tad crabby as our day started at 5 am today.....so a bit less
tolerant of the ignorant.)
