Divorce Question
Hello all, I have a question I am hoping someone can answer for me. I am
married to a man fromThe Netherlands and I am from the USA. We have been
married 2 and a half years and our marriage is registered in both countries. My
husband recently got his k-3 visa so that he could live with me in America.
Well he was suppose to be moving here on June 29th and I just got a phone
callfrom him and he said he couldn't do it. He had already asked for his job
back and promised his family he wouldn't leave Holland. Needless to say I am
heartbroken. We were together 4 years and now this happens. His K-3 visa will
expire in another year and a half. Since he won't be needing it again. does he
just give it back? It is stapled inside of his passport. He said things would
be different if I could live in Holland but I can't. I have children and they
are not allowed to live there. Do I need to contact the INS and let them know?
He says he wants to visit the USA again. Can he travel on a visa waiver after
we are divorced? His name is already in the INS computer as being my husband
and if he tries to come to America without a visa, then there could be trouble
for him. I know I shouldn't worry about this, but I do because I love him
alot. Please let me know if I need to contact the INS and let them know.

Sorry to read that you and your husband are still having problems. I thought he was scheduled to arrive in December, 2002 with his K-3 but see that he postponed that arrival until now. As long as you two are still married there is always the remote possibility that he will once again change his mind and while still married the K-3 is valid.
After your divorce I personally don't see why he can't use the VWP as he will have no immediate relative in the US that would deem him a possible emigrant.

He got his K-3 visa in Sept but he didn't use it until Dec for x-mas and he
only stayed for 2 weeks because he said he had to finish up his job. Well he
postponed the date on coming here until June29th of this year, and now he
doesn't come at all. We took out a loan together in Holland so he could pay
off his debts in Holland and he ended up spending it on a new bike and new
laptop. Guess I was fooled for many years. He claims he still loves me lot
but that's another lie.

Hmmmm and now you are on the hook for a loan in NL as well as your debts and living expenses in the US. Damn I hate to think of you having to pay off this loan by yourself if he defaults.
Again, I'm sorry that this marriage has not worked out for you. Love is a wonderful emotion but I've seen over the years so many people who have migrated to the US to be with loved ones find that love was not enough to sustain a marriage when the migrating partner cannot adjust to living in a new country. More the pity that your former spouse will not allow your children to migrate there. What a wonderful experience it would be for them and you to live in Holland for a few years. Air travel is not that expense and the kids could always go back to the US for summer vacations and holidays. But that is life isn't it. Never quite turns out the way you imagine it would.
