DCF when I-130 already pending?
Hello everyone,
Hope there is someone out there that can help. I have recently filed
both the I-130 and I-129 F for K3 (already got 1st NOAs for both).
Then today, I watched a show on ZeeTV (an Indian channel) the talks
about Immigration issues. ON this show, one of the hosts mentioned
that you can do a DCF which will advance your filing status by at
least 3 months (meaning you will get your CR-1 within 3months). He
also stated that even though you have a pending app in the states, it
is possible to DCF in an American Embassy abroad (for me it would be
New Delhi).
Can anyone confirm this case? Is it possible to DCF abroad even when
you have a pending app in the states? Oh and BTW, my last 1st NOA for
the K3, I-129F is Dec.21.
Hopefully M.Udall or Folinskya might have some insight. As everyone
on this board, I am trying every possible legal avenue to be with my
wife as soon as possible.

Yes, you should be able to do this and cancel the I-130 and I-129F
already filed.
You should also let the consulate know that you have filed the I-130 and
129F.
DCF should be your first choice if you have the ability to get to your
spouse's country and they permit a non resident US citizen to file DCF.

Not all consulates will do DCF for a non-resident US citizen. You should
contact the consulate in question and ask them if they will do it. It is
entirely at their discretion whether they agree to do it or not. I have
never seen them do one for a non-resident, but anything seems to be
possible in immigration matters.

There are a few that do DCF for non resident US citizens.
In 2000, we did it in Moscow.. However, DCF there is no longer possible
for non US Citizens that do not live in Russia.

There are a few that do DCF for non resident US citizens.
In 2000, we did it in Moscow.. However, DCF there is no longer possible
