Yesterday i got made redundant from my Job in Malta so ive been thinking of options.
We are waiting for my partner to get divorced before we get married in July in the US.
The original idea was to leave after two weeks and submit the paperwork for CR1 and work and wait.
Now im wondering if it is possible to get married in July, submit the paperwork for CR1 whilst there on my B2 visa then return to Malta before the 6 months is up to hopefully complete the final steps. Stay in Malta for as long as is needed to be be granted the visa.
I hope ive been clear and am not doing anything dodgy.
thoughts please

Sorry to hear about your redundancy, TCC.

As far as I understand, you can submit your I-130 and accompanying paperwork while you are still in the United States, yes.

I don't personally know whether a ~6-month stay thereafter would have any impact on the processing of your CR-1 or indeed your B-2 visa - I'm sure somebody with more knowledge will be by, soon, to advise. I would say that you can't really take "six months" as gospel for the processing time for the I-130, though, so be mindful there - we have to take these timelines with a pinch of salt.

Yes - completely doable! You'll need to be in Malta to do a medical and interview at the Consulate... but that'll be several months down the road.

It'll have no negative impact whatsoever on either.

I think the 6 months he's talking about is simply the duration of his stay on the B-2 visa... nothing to do with the visa process.
