cosponsor dropped out last minute
Hi,
I made about 50,000 in year 2003, 10,000 in 2004, and will have made
53,000 this year. When we originally applied for AOS, we had a
cosponsor to supplement the 2004 income. The cosponsor told me 5 days
before my interview for AOS (I am sponsoring my husband), that she
isn't going to do it. The company I worked for in 2003 is the same
company I work for now. What are our chances of getting approved?
Anyone have a similar situation (the average of all 3 years add up to
more than poverty level for each year, but one year was below poverty
level). Now we did receive money from random people in 2003 but I did
not report this on my taxes. My taxes only report about 10,000. Can I
just show my bank statements where I deposited money and where it might
add up to over poverty level for my household?

Sorry, I don't have any information to offer, but if no one is responding on here, try visajourney.com, maybe someone there will know something? I know you're interview is today, but its worth a shot to ask if you still haven't figured anything out.
Can you call USCIS and ask their advice?
Hopefully they'll see how much you've made this year and that will influence their decision, as I've heard thats the main thing they look at.

Jen,
Might well depend on why your 2004 income was so far below 2003 and 2005.
What's important is that your currect income is both sufficient and sustainable. Your income history might give clues as to sustainability. If the clues are positive you may not need a joint sponsor, if the clues are negative you may need a joint sponsor.

I'm late to this topic so this might not help you anymore, but we were approved at the consulate with the middle year income a few hundred below the level for 3. They did ask why, but it wasn't a problem.

All, thank you very much for the responses. I contacted a different
lawyer (not my own) and she advised me that we will be fine. The fact
that I am making over the 125% of poverty level for a household of 3
for 11 months is very good. Also, I do have a reason I was making very
low for the year 2003 and have explained it in an explanation letter
for our new I-864 Part 4, C.
Our interview is in less than 12 hours, I will post the outcome.
