Confusion with EAD
My fiance arrived in late August. He immediately applied for the EAD. We
received notice from Immigration that the anticipated processing time is 80
days. We are not getting married until mid-November. It is my understanding
that the EAD expires when we marry. It this correct? If so, what are we
supposed to do considering based on the information provided, he will not have
the EAD until after the date we marry? Will he not be able to work until he
files for the EAD with the adjustment of status, in which case, we have to wait
another 80 days? Could somebody please clarify this matter? Thanks

Re: Confusion with EAD
It appears that your fiancee applied for the 90 day temporary EAD. Well that is just it ... it is only good for 90 days. Chances are it will only be vaid for about 2 weeks by the time he receives it. Even if it were for the full 90 days, your marriage does invalidate it.
It is unfortunate that he will have to apply for the one year EAD after your marriage and at the time he applies for AOS. And unfortunately the answer is yes. He will have to once again wait the 80 odd days for the EAD to be issued.
