Confusion about I-130

Question Confusion about I-130

I sent off all my applications about 2 weeks ago and saw this morning that all my checks had been cashed. I sent I-130, I485, I-864, I-765 and I-131 (as I want to return home in the summer).

I live in Atlanta, GA but I am now confused after reading another post, that the I-130 is for people NOT living in the US. IS this correct??

I am currently here on a J-1 visa, and when I called the USCIS, they told me which forms to fill out.

Can someone confirm or put an end to my confusion?

If you applied based on marriage to a USC, you were right to file the I-130. That is actually filed for you, the beneficiary, by your USC spouse, the petitioner.

That is not a true statement. If you did not enter the US with a K-1 Fiancee Visa, you most certainly need to include the I-130 with the rest of the forms. Only K-1 visaholders do not have to file an I-130.

Thanks, OK that puts my mind at rest!! Yes, my husband filled out the I-130 and I was already here on a J-1, not on a K visa.
