Its in the regulations.

Some people might say "RTFM" but I prefer "UTSL" -- BTW, I've been noted for using "RTFM" on the private lawyer listserves. Last year, an attorney asked a question, and not a bad one -- and two other certified specialists gave a succinct and accurate answer. Well, another attorney begged to disagree, but started off with "I have not read the regulations, but it seems that ..."

Since this was on a LAWYER's listserv, I responded "If you have not read the regulations, then you don't have any business responding" and then gave the citation to the answer. I got many "way to go!" e-mails after that and still get pulled aside by colleagues in the halls of CIS.

My reference was ambiguous. I meant the American petitioners and yes, we are seeking a direct benefit. Paul Gani was suggesting that the immigrants were the ones who would be paying these fees but in fact, their American sponsors are the ones who actually pay them. Again, I really have no problem with the fee increases. I better send the I-130s and I-485s in for my three stepchildren as soon as they get here!

Ok, I guess even though the form clearly states that you should not need it, others have had problems. That really sucks! Once again I'm as confused as you are.

I was under the impression that once you filed AOS you had to have an AP to travel outside the US. Leaving without having an AP to get back into the US would be considered abandoning your AOS application. I personally walked into our local office, Indianapolis, for our AOS papers and was given the AP application also. I asked if it was needed even tho we had K3 and K4 visas and the answer was a definate YES. Yes, the K3 is good for multiple entries up to 2 years, as long as you've not applied for AOS.
I won't travel without an AP for the shear fact of a *possiblity* of not being allowed back home to my family here in the US.

What you were told confirms what I've heard elsewhere - different CIS offices or personnel have different understandings as to whether or not a K3/K4 requires advance parole, not withstanding what the regulations say.

But again - the issue is not whether or not you will be allowed back into the US after traveling abroad. The issue is whether or not your local office will consider that you have abandoned your application to adjust status.

By chance did you take with you to the Indy office a printout of the information from the CIS web site that clearly says a K3 does not need advance parole? I'd love to know how they'd react to that.
