chinese marriage visa question
hello,
I am new to this group. I hope someone here has some information and
can help direct me a little.
I have a girlfriend in China, who I am considering marrying in China
within the next two months. I would like to know how long it would take
to get her here legally. She does not have a visa. She told me it would
take from 8 to 10 months for her to get the visa after we would be
married. I believe we would submit the K3 visa application, and we
would have to go to the US embassy in China and apply.
I hope there is a way I can get her here sooner than that.
If someone is familiar with the procedure, and mostly how to possibly
get her here sooner than 8 months post-marriage, that would be very
nice.
Much thanks.
Keith

Unless China does DCF (direct consular filing, where you submit an I-130 directly to the embassy), then your girlfriend's prediction is probably true, or even longer. Check with the embassy to ask what the requirements are for you to file an I-130 directly with them after marriage.
If you cannot do DCF, then you will return to the USA, file an I-130 and then an I-129F (for the K-3). Whichever one gets process faster is the one she'll end up having an interview for. I-130 leads to an IV Immigrant Visa, whereas the I-129F leads to the K-3.
I know there are a couple of sites out there which deal only with visas from China. You might want to search the internet more, and get some information from those sites. I believe there was one called "candle for love" or something like that?
Best Wishes,
Rene

Re: chinese marriage visa question
thank you. I will look at those sites.
I have a quick question. Might it be better if we were to get married
in the U.S.?

And if you DO qualify for DCF, getting married in China and going that route is usually much faster.

With all due respect Rene, I believe he wants to know whether the K-1 route would be faster than K-3, in his last question.
The following statement is therefore incorrect in that context:

If they have met in person at least once in the past 2 years, they can certainly do a K-1 fiancee visa. I don't know if it's any faster, but if they are qualified right now, he can start the process now instead of 2 months from now, which gives him a 2-month head start.
