Child on K2

Default Child on K2

My fiance has a 2 year old daughter. We are worried that the biological
father may try to prevent her from getting the K2 visa. He is not listed on
the birth certificate and has never seen the child but has threatened to not
allow them to leave to USA. Does anyone have any experience in this matter.
I know that we are not the first to apply for K2 in addition to K1. They
live in Lithuania. We will use the embassy in Warsaw.

Is there any father listed on the bc?
If he has a valid claim, then he could cause a problem.
This may involved going through court in Lithuania.

Personally, such people shouldn't be told the child is leaving.
Apparently he found out, so that is a different story.

If there is a father on the birth certificate then make sure she gets a
statement from him, if possible. As far as the other bio father goes, if
he hasn't filed any court documents, then I would watch who she tells
about her departure. In the case of such non parental bio parents, let
him fight his legal battle from a few thousand miles away. Yes, you got
it.. I am condoning skipping the country without his knowledge. I am in
favor of parental rights, but this is a bit different.

I suspect he is looking for payment. It is not uncommon in the FSU.
FWIW, my wife is Russian. Our daughter was 5 1/2 when we started the
process. She hadn't seen her bio dad since she was an infant, and her
parent's were married at the time. My wife tracked the bio dad down and
had him sign a document (in front of a notary) indicating permission to
live in the US, permission to be adopted, and permission for our
daughter to take my name. He didn't hint of any problem that I am aware
of.

I also have the same problem... My son is going to the US on a K2 and
while there is no father listed on the bc, his biological father has
threatened to make some noise.
My understanding is that since I have sole custody, I make all the
decisions. I think that where there's a case of no father on the bc,
the biological father would have a long road ahead of him in trying to
cause problems. However, I'm sure the laws in all countries are
different.
My lawyer told me that since there's "legally" no father there's not
alot he can do in a short amount of time. So, leave as planned, if he
wants to do something after the fact, good luck, he'll need an
international lawyer.
Hope that helps! I'll let you know if anything changes for me as I
have not yet gone to my interview or crossed the border!

No father is not on the birth certificate. He does not know she is leaving
but her twin sister came to America 2 years ago and he warned her at the
time (When she was pregnant) that he would never let her leave.

An online friend of mine in India, filed for a court order stating that she had sole custody.....
They were never married, the father's name was not on the birth certificate.

I would think that because there is no father on the bc that adopting her
child would be no problem for you .. I wouldn't imagine that a US lawyer
would ask for anything but the bc for adoption purposes.... again, this is
assuming that the biological father has no rights whatsoever and has not
tried to do anything in the mean time. I wouldn't worry, once you get her
out of the country, you'll all be fine!

If there is no father on the birth certificate, then you shouldn't have
a problem with the adoption.
If he was on the BC and had no contact with the child and paid no
support, then in many places the adoption would still be relatively
painless since it would be nearly impossible for him to fight an unfit
parent battle from where he is.
