Default Canadian Citizen

My fiance, who is a canadian citizen, was denied entry into the U.S.
Their reasoning was that she had no ties to canada when we were entering
the states. They told us what documents they needed. We produced them
the following day, they then told us that was not enough. I had to leave
her there. We are now ready to get married. If she were allowed in the
US, would we be legally allowed to marry, or do we need a fiance visa.
She is thinking about coming down for the summer, but we are worried
that they might say she was not allowed to get married in the US. What
are the ramifications if she does come down. I would like to go up to
canada, but travel is real expensive now and we are not sure if we could
get all of the paperwork in order to leave canada/enter the US in time.
She has been in the states for a few days here and there and was never
questioned at the border. We definitely dont want to break any laws. Are
there alternative ways for her to join me in the US? Any and all help
would be great.

Why don't you just follow the law and petition for her to get a Fianc�e Visa
(K-1)?
A Canadian citizen needs a K-1 visa to enter the U. S. for the purpose of
marrying a U.S. citizen!

If she is able to enter the US, she and you can marry but she cannot remain here while the paperwork is pending. The issue is that she is entering the US with the intent to marry and remain to adjustment status and this is a no-no.

You waited too long to insure that she will get a fiancee visa this summer. Depending on where you live which governs which service center you will have to use, the wait could be from 3 months to 8 months. Once the I-129F is approved stateside it is sent to either Vancouver or Montreal (her choice) and she then completes the K-1 process there.

I suggest you avail yourself of the knowledge on the alt.visa.us.marriage-based forum which was set up for just this purpose.
