Are you family-based or employment-based? If family-based, why change,
Just drop him/her if he's no good.

I was told (when called USCIS) that one must write to USCIS to informt
that he/she is no longer your lawyer. But I don't know I trust the info
form the incompetants who work at USCIS.

I simply went to my AOS w/o my lawyer after she put the wrong birth
date on my application. But I was well-informed about my case (not by
my lawyer but by researching; I gave her the case because I was so busy
at the time).

My husband got GC by employment-based. We file together by his
corporate lawyer. But mine is still pending. And the lawyer won't do
anything. In this case, can I change?

thanks

My guess is the corporate lawyer is not obligated to assist you in any way since you are not an employee of the company. There is nothing to stop you from hiring your own lawyer.

If you are currently being represented by the corporate lawyer, your application will have a G-28 (I think that's the right form number) on top. Form G-28 tells USCIS that Attorney X is representing you.

If you want to change lawyers, you tell your current lawyer that you don't want to work with them anymore. They will send a letter to USCIS informing them that they are withdrawing from your case (if there was a G-28 filed). Then you just get a new attorney and the new one files a new G-28.

You are not required to have a lawyer. Just tell the old lawyer you don't want to work with them anymore, and bada-bing, you're on your own.

You are not obligated to represent a new lawyer. Oh... are you qualified to represent a new lawyer? I mean... he probably knows the law and you probably don't!

Probably is the right word because sometimes the lawyers don't know
what they are supposed to know and the non lawyers know enough about
their case.

You are such a loser, Ian, assuming that OP needs a lawyer. Her hubby
got it approved and hers is a clear cut case. I'd say no lawyer if she
doesn't want to.

Really? How do you know this? She gives no indication of her current status... she may currently be out of status, in which case her husband having a GC isn't going to do her any good. This may not be "a clear cut case"... but since you always champion the underdog, you'd probably be happy to ignore any inconvenient issues.

Have you made an Infopass appointment to find out what is going onwith your case? With emloyment-based AOS, the spouse (+/- minor children) is/are normally approved at the same time. An exception could be a delay in security clearance. But unless you find out the current status of your case, who knows.

Ian, Ian, Ian, the only way the corporate lawyer would have been able
to file for her GC application (AOS) *along with* her husband's meants
that she was on a dependent on her husband and was on valid status.
Duh!

You, OTOH, don't read between the lines. Do you think that corporate
lawyer would have filed for her GC unless she was clearly eligible for
it to file *along with* her husband's?
