Boston office no longer accepts EAD and Advance Parole applications with AOS

Default Boston office no longer accepts EAD and Advance Parole applications with AOS

Just saw this on the USCIS website:

Please note effective February 13, 2004, the Boston district will no longer
process I-130/I-485 applications or any application submitted in conjunction
with an I-485. This includes I-765 employment applications and I-131 travel
permission applications. We will accept the applications, by mail or in
person, with fees attached and forward them daily to the National Benefit
Center in Chicago, Illinois for processing. You will receive a filing
receipt from that office within 21 days. All employment documents and travel
documents will be mailed directly to you from the National Benefit Center.
Residency interviews will still be conducted locally once the case is
transferred back to Boston. Any employment or parole applications for cases
currently pending here in Boston must also be sent by us to Chicago.

Damn. I was hoping to be able to file everything together when we went in
April. Does it make any sense to mail in the I-765 and I-131 before we go
apply for AOS? Can we do it before we even get married?

As you have to have some basis for eligibility to file your travel permission and work authorization, they won't allow you to file those without filing your AOS papers first.

I can't believe this aaaaaah!!! I was really hoping I'd be able to walk in to Boston office and do my filing esp for my EAD permit as I need to start work as quickly as possible.

May I ask you one question?

On what are you basing your right advance parole and employment authorization if you have not filed for adjustment of status?

It is unfortunate but it was advised in the forum a few weeks back when someone else was going to be using Boston and found out this information and let us know then. Boston is apparently now participating in the same program that many NE District offices are participating in whereas the NBC will take some of the case work off the DO in hopes of free up workers to handle the present backlogs and hopefully, streamline the A/P and EAD processing.

Can we do it before we even get married?
Nope, you have to fulfill the K1 first by marrying within 90 days of entry then you adjust your status and you can't file for the advanced parole before you file the AOS.

Hey, no need to get snippy. I wasn't claming any right. I was just asking.
I read this newsgroup pretty often, but I guess I missed the earlier
discussion. If I had seen it, I wouldn't have posted the info again.

My main purpose was to get the info out. I only thought of the question as
I was typing my post. I didn't think it would be possible, because I don't
remember reading anything about people doing it. But I didn't think it
would hurt to ask.

I was counting myself lucky that we were applying in Boston because it
appeared that we could do everything at once. Now it looks like that's no
longer the case. I hadn't really been paying attention to the application
procedures for EAD when you have to mail it in. Guess I better start
learning!!

I wasn't snippy. I asked you an honest question in a "tone" I always use. No reason for you to be offended.

No it did and doesn't. But I was asking you on what basis you felt you had to file for A/P and EAD before filing for AOS. From your question I would take it that you have not looked into the matter, not read the FAQ, nor read the instructions for any of the benefits you will be applying for in the future.

Boston's site says you can still file in person only thing that has changed is that you will no longer be eligible for the EAD and/or AP the same day. Unfortunately, your district office, albeit yourself, have joined the line of thousands of others who have to wait out the processing in what USCIS deems an efficient and orderly manner ... NOT.

There you go using a "tone" again. Look, if you're not going to be helpful,
please don't answer the post. There are plenty of people on this forum who
are happy to do so. I don't know where you get off scolding me when you
have no idea what I have or have not done.

For your information, I have done extensive research on the the requirements
for the various things we have to do (K-1, AOS, SSN, etc.). Including many
hours reading USCIS website, the various FAQ that people have posted,
reading this forum almost daily, etc. As I said, up until yesterday, I was
smugly assuming that we wouldn't have to worry about waiting for the EAD
because up until this month the Boston office was issuing them on the same
day as the AOS application. The question occurred to me as I was writing my
original post.

You're right of course, it makes no sense that we would be able to apply
for AP or EAD before filing for AOS. And if I had thought about it for 2
minutes I probably would have come up with the same conclusion. But again,
I never thought I would be scolded for asking a simple question.
