Here are the details: An acquaintance of my wife whom she met during her
immigration interview came to the US back in June of last year under a spouse visa.
She found out when she got here that her husband has a mistress. My wife's
acquaintance says her husband abuses her. She wants to know what options she has as
far as immigration matters are concerned. She's gainfully employed now and her
husband takes her salary from her. Can she leave her husband and still qualify for
her petitioned immigrant status?
TIA, Greg

sounds like she can sue the government, maybe God, since her friend's husband was
born.

The acquaintance should consult an immigration attorney. She is eligible to apply for
removal of conditions on her residency IF she can PROVE the abuse. It would be highly
advisable to get an attorney's counsel on the advisability of doing this in her
situation. It certainly is a possibility, however she may need to do some things to
show proof, and the attorney can give her the scoop on how best to do that. Alvena

I am not a lawyer and this is not immigration advice. This is my personal opinion,

Before this acquaintence seeks an immigration attorney, I would have her seek out
some help. If her spouse even remotely suspects her plans, he may become even more
abusive or go to the INS authorities whith some made up story to have her deported.
Have her seek out social services asap. They may even assist her in finding an
immigration attorney.

She should file for divorce. If divorced, she can apply for removal on her own.
If she stays married, she would have to prove the abuse in order to file on her own.
If she is really being abused, then she should leave. If she doesn't have the money
to hire an attorney, there are groups that assist battered woman in filing.
