Dear all,

If you have a I-551 stamp on your passport (which is like a GC stamp). Does it mean that you have a green card right ?

But if your I-551 stamp says "issued an error FBI name check pending" what does it mean ? According to my lawyer you have Temp GC and you can travel too. Again, my name check for GC is pending ?

Yes.

If it says "issued in error" (which is not what you wrote), then you don't have a GC.

I think you lawyer is incorrect. GC's are not temporary. They may be conditional... but not temporary.

If your FBI name check is still pending, that means USCIS does not have approval to issue your green card yet...therefore, if you intend to travel, you should use AP if you are eligible for it.

There's no such thing as a "temporary" green card, to my knowledge.

Yes, I have a stamp on my passport which is I-551 stamp issued in error. Also, INS provided me a letter that says "your name is still in pending"

my question is, I need to switch my job but since i have stamp which shows "FBI name check pending" does it effect to my employer or is it a valid GC ? According to my lawyer, i have a valid GC and i can even travel but just want get second opinion.

I really appreciate your help and advice.

I think your lawyer is wrong. It sounds like they stamped your passport by mistake, and wrote "issued in error" to cancel the stamp and correct their mistake. Since the stamp is cancelled, you don't have a green card, and you cannot work or travel using that stamp. You still need EAD to work, and AP to travel.

I had the same in my passport... it was stamped before they realized the security checks were not completed ... the stamp was voided by the USCIS at the first opportunity ... ..your stamp is worthless....

obviously !! until you security check are completed.. you have no status as such ..I waited a further 3 months for completion of security checks before they were completed and passport was stamped again ..

It doesn't matter what else your stamp says, the important thing was that they cancelled it afterwards! The "issued in error" means you don't have a stamp, and therefore that you don't have a green card.

Yep: issued in error means that it might as well not be there. Act as though you have no GC.

Right, it means you don't have your green card yet. It means they stamped your passport with the I-551, thinking all was OK. Then they realized your security checks are not complete, so they wrote "issued in error" which means they invalidated the stamp.

You current do NOT have PR status.

You DO need EAD and AP for work and travel.

I'm very surprised your lawyer is telling you otherwise, unless he/she knows something the rest of us don't know...in which case, please keep us informed.

First, i recieved an approval letter from INS. I went to immigration office, they stamped on my passport and they told me that you will be getting a card in mail, when i didnt recieve anything i went there again and they stamped on my passport again with "issued in error, FBI name check pending and I-551 valid upto ... this month".

Switch your job? So, are you currently working? Based on what? Work
permit? If your work permit is still valid I would say that you are
eligible for employment based on your work permit NOT GC. Just my guess

You need to be careful: the "valid up to..." may be part of the ORIGINAL I-551 stamp, in which case it is invalidated by the "issued in error". It seems unlikley in the extreme to me that a cancellation due to name check still being pending would not take effect immediately. If I were in your position, I would assume that the I-551 is NOT valid, and would act accordingly. Your choice of course, and your attorney may be telling you something else, but I know how *I* would act.
