Hey guys,
We've made it passed the fingerprinting.. There was really nothing to that, aside from
loacting the building! That was tough enough!! hehe.. anyway I'm going over the list
of items that INS has requested we bring for the AOS interview.. I have a question..
nothing new, eh? : )
Anyway.. one of the items on the list is "Affodaviate of Support" (I-864) .. I need to
ring INS for this form, correct? This isn't the money form again is it? I'm praying
for a no answer on this one!!
Also, does he need to get ANOTHER medical exam, or will the old medical exam work
fine? He has the papers and all that from the exam he had before leaving Australia..
We have this interview in two weeks so I'm desperate for answers fast! hehe.. I'll
spend the next two weeks freaking out.. anything new there.. nooo! : ) Thanks for the
help in advance guys!!

When did you submit the I-485? and where? This has a lot to do with it.
If the medical is less than 15 months old, then you should be fine. In fact many local INS
offices don't require it for K-1 regardless of the length of time.
If you submitted an I-864 with the I-485 and you have been married for a while you should
at least bring the latest filed federal tax return. Did they ask for tax transcripts?

We filed in Memphis shortly after we were married. We attempted to hand them a
copy of the medical then, and the women at the desk said they didn't need it
at that time. We filed back in November of 1999.

They asked for the following:
Benificiary Birth Certificate Petitioner's Birth Certificate or Naturalization
Certificate Marriage Certificate Photos of you and your Spose Affidavit of
Support (I-864) (I have no clue as to which form this is or what it does.. )
Support Documentation Divorce Decrees (you and your spouse) G-325A for both
Medical Exam (I-693) I-130 approval notice if applicable Evidence of common
residence & shared life
That's what they have listed for us to bring.. I thought we could use his old
'medical' but I'm not sure.. and in regards to the I 864 form.. I don't have a clue
what it is or what it does.. I think your brain goes empty after you have a baby!
HELP!! : hehe

If you handed her the medical back then, then you didn't come on a K-1 visa. Personally, I
would redo the medical. The I-864 is the affidavit of support which will be binding
legally on the USC. Normally one is given at the time you submit the I-485 and you just
bring updated tax returns. If you didn't submit one you will have to do so now. You can
d/l it from the net. It requires three years of tax returns from the USC who is the
sponsor of the foreign spouse. You need the W-2s to go with it. You can order the
transcripts from the IRS over the phone. They come within ten days.

My husband did come over on a k-1 visa... he had a medical done before leaving Australia..
we were under the impression he was suppose to file those papers with the rest of the AOS
'stuff'. However, the women there had said he didn't need to.. In which case we still have
the origonal and the copies we made of his medical, but that was done back in September of
99 in Australia. Alas.. I don't know what to do or which Dr to go to even to have it
done.. Somehow, my poor peabrain has lost all it's info.. I didn't think we needed to have
the medical redone at any point and time??
I think the pictures they are refering to are ones to prove we have a valid marriage..
all I can say is it would be a fool to go through this kind of 'stuff' for a
greencard! I know they do, but sheesh.. I just don't think it'd be worth it if you
weren't truly in love with someon! : )

The medical was suppose to be given and taken by the US Consulate at the time of the
K-1 interview. You are not suppose to have the original nor a copy as it is in a
sealed envelope.
