Default AOS Interview; question about I-864

Hello Guys:

My husband who holds a K3 Visa has his AOS interview coming up in a few weeks, we are so nervous. Anyhow, he has been employed for a year now. Can he file his own Affidavit of Support because he meets the poverty guidelines or do we need to find a co-sponsor? He has only filed 1 income tax return.

I (his wife) am unemployed, do I still need to file a I-864 and do we need the co-sponsor?

"The Affidavit of Support Under Section 213A of the Immigration and Nationality Act (Form I-864), which **must be completed by U.S. citizens and lawful permanent residents** who sponsor family members as immigrants to live in the United States for immigrant visa and adjustment of status applications filed on or after December 19, 1997. "

So by this USCIS definition I would think (but dont know!) that you will need to find a sponsor despite your husband having a job. Hope Im wrong...

Claudia,

Unemployed or not, you are your husband's sponsor and you must provide an I-864.

If your husband has been living in your household with you for more than 6 months he can be your joint sponsor.

So with current average timelines for AOS interviews being over 6 months your saying pretty much everybody can use the combined income of both for the affidavit of support ?

Did you not have to submit an I-864 form when you applied for the AOS interview ? and if so why the need for the second one ?
