Default AOS - CHANGED?????

We filed for our AOS in florida - Tampab sub office - Almost two years
ago (two year wedding anniversary is Oct )
I received a letter from them which kinda surprised me.

It says to mail them in proof of a bona fide marriage along with the
2003 tax return. It then says to do this within 45 days and they may
be able to make a decision on my case. (that basically sums up the
letter)

I thought this letter came with your interview date for AOS? I thought
we brought all this information in when we had our interview date.

Anyone know what is up??

A little confusing, but I'm wondering if they're treating your case as they might for removal of conditions, as you filed almost 2 yrs ago. They said they may be able to make a decision on your case as long as you send the required docs. I know that some people don't need to be interviewed if they're filing for removal, but I don't recall anyone not having an AOS interview. Then again, that would explain their need to see evidence that WOULD normally be required at the AOS interview. Puzzler, and I'm curious to see the responses to this thread.

This happened to someone in the CanAm couples group -- and I believe the local office was in Florida, but I don't remember which city. Congratulations - it sounds like you may not need an interview! I do know of someone who filed AOS through the Albany office and they never needed an interview - in fact, they just received the approval notive and green card in the mail one day. Also, the officer at our local office (Buffalo) told us that an interview is not always necessary for AOS.

No they are not confusing you with a removal case. Others, although it has been infrequent, throughout the US have been reporting that people are being approved for Adjustment WITHOUT interview. It looks like Tampa is offering you two the same privilege. So do up a binding of evidence, just as if you were to take it to the actual interview and send it off to them. Good Luck

Omgosh wouldn't that be great if we all could do that!! No more taking time off work for USCIS! Have other service centers considers this?

Great News!! Tampa is 2 years behind with AOS interviews
I think they have been told to speed up dramatically...Your the winner...

Yep, I know of at least 1 person going through the Louisville, KY office that got approved without need for an interview. She was told by her immigration attorney friend that almost all AOS petitions were being approved there without an interview. Good news for us since it's about a 75 minute drive. So this is actually quite a common thing that is occuring.

Only 75 minutes? That's nothing. It's a *2 1/2 hour* drive for us. We filed for removal of conditions in December, and are planning on going to England this Christmas, so we might have to make another trip to get the stamp (just to be safe) if we haven't heard anything "official" by then (we got the receipt letter from TSC, and know they are running about 11 months behind processing I-751s at present).

OK I wanted to clarify a couple of things

Here is exactely what the letter says

Dear Applicant
The US Citizenship and Immigration Service (USCIS) is committed to
providing better customer service for thos seeking permanent residence
(form I-485). For this reason we are asking your assistance.

We have enclosed for I-72 (request for documents) and ask that you
complete the attached forms and provide our office with documents
needed to make a decision on your case. If ALL documentation requested
is submitted in 45 days or less, our office may be able to make a
decision on your case.

Please read the enclosed forms carefully. When you have completed the
requested action please mail them to ...

(mailing address for tampa inserted here)

We ask that you mail your documentation via regular mail, not
certified. Certified mail may cause a delay in processing. We ask that
you DO NOT attempt to turn in your forms in person; this will also
cause delays. Your full cooperation in this matter would be greatly
appreciated.

Our office will contact you by mail or by telephone to complete the
final action on your case.

The enclosures state 1)
Complete the attached questionaire
2) submit 2003 tax return
3) submit current earnings, pay stubs, letter of employment
4) Submit proof of bona fide marriage and shared life together (Bills
in both name,s bank accounts in both names, birth certificates of
children born to marriage, purchases made together, schol records ect)

The enclosure actually has about 20 items on it but only the above
four have a check mark. And the questionaire is pretty basic , where
do you live, where do you want your alien card mailed to, date of
birth, full name ect...and has to be notarized.

So thats what I got..and thats what I am working on..for all THREE of
us. I immigrated with two children.

Most of it is complete, I am having a little problem wiht my 14 year
old. He has no SSN, to young, no job to young, no car, to young,
basically I am sending his school records which has our address on it,
an letter he received from canada with his name on it, and a Dr bill
with His name and address on it.

My 17 year old, has a job, a car, an EAD, insurance so she has lots of
proof that she resides here.

Myself, sending marriage certificate, car insurance, car title, car
registration, bank accounts with both out names on it, receipts with
my name and address on it brighthouste network cable and internet
bill. Stuff like that.

Also sending financial stuff..
So that is the gist of what we got in the mail. I will be sending it
out monday or tuesday (one form needs notarized) and then we wait.

I will be sure to update here when I hear something back from them.
