ya, but basically then have to fly back and forth atleast a couple times before its worked out?
quite annoying, we were really hoping there was some sort of extended visa that would be easy to get, finding out that its just a huge pain!

Maybe they make it difficult to keep out people who don't want to put effort in.
It's a straightforward process. It just takes a while to complete. We all had to go through similar situations.

Ignoring the replies and responding to the thread title, yes you can go to South America and get a new 90 days on return to the US. I did it 6 years ago. Not so for Canada, Mexico, and parts of the Carribean.

I am almost certain that this will be a case of lets try 'no huge penalty' way of doing it.
This is where it gets to me. The laws are so biased (and that's just my opinion) toward family immigration. You can overstay and still get a visa yet lots of folks who want to genuinely be here as tourist have next to no home getting a B2. Not that I can do anything about it...that's how we roll here.
To the OP - there is no 'I want to live here for a year before I get married' visa. Couple of posts before mine are the choices you have. I would do the right thing or risk a ban.

Correct. They would either get 90 days, or stuffed back on a plane, usually back to where they just arrived from.

Is it luck or is it fact? Ok, so 90 days is max and the official can grant anything less (including no entry) but are you just over complicating a question which, on the face of it, is simple enough? So 89 days in the US followed by a week in Brazil might be different. But those extreme circumstances were not posed.

And, as noted on his other thread, he has already been turned down for a B2, so is seen to be trying to spend a lot of time in the US.

right. ya the vibe im getting from many many sources is its ALL up to the officer at the counter when you enter the border. very strange in my opinion (to have no set or fixe'ness'), but i guess for such a large country what can they do.
right, so would that really be practical to do then when the immigrant visa application is in progress?
Don't you have to earn your living in the meantime? That's what the border control will be wondering . . .
