Default answers about the looonnnnggg wait

Hello all!
I just wanted to update my story for anyone who is intrested.

I got my 1st NOA from MSC OCT 9. I called INS January 17th to find
out what was going on. They told me at that time that my case was
given to the adjudicator January 10th and they were waiting for the
background checks and his "A-FILE" they also said to call back in 2
weeks if I didn't hear something by then......I called back and they
said the same thing, still processing and be paitent these things take
time, everything looks good call back in two weeks if you don't hear
anything. This began the saga for me, every 2 weeks I call. Finally
after reading a post hear I decided to call mt senator and see if they
could help. I faxed and emailed them and was told I would hear
something in 2 weeks. Well I decided NOT to wait two weeks, I am so
glad I didn't. I talked to a wonderful women today the immigration
liasion, named Kristi. She was wonderful. She didn't realize I was
assigned to her and was glad I called. She got right on it emailed
her contact at MSC today called me back 4 times and guess what she
found out:

THEY STILL DON'T HAVE THE A-FILE!!!!!!!! This means for the past 50
days they have done nothing, put my case on the shelf until they got
the file, well surprise I KNOW for a FACT that DENVER no long has it.
My husband also has a bond that will be released from Denver and they
can not release it because they sent the file to MSC, and guess when
they sent it???? OCT 24!!!!! MSC requested it and it was sent at
that time. So MSC has miss placed his A-file. We have been waiting
all this time for NOTHING!!!! They screwed up, miss placed a file and
were doing NOTHING about it! So now I am releaved...she is making
sure there will be an investigation and that the file will be found
and it will happen NOW!!! She said they should have realized their
mistake after 2 weeks and THEY should have started an investigation
into where the file was.....but they never did. SO now our case is
finally going to get somewhere, God Willing!!!!

So why am I telling my story......when in doubt CALL EVERYONE YOU
CAN!!!!!! Find out WHEN your case got started on. If they have had
your case started on for more then 3 weeks sound the alarms. I wish I
would have sounded the alarms a month ago......I am am thankful I did
it now, NOW maybe we will get somewhere and my husband will be here
soon. The saddest thing is, if I would not have done anything it
would have been even longer wait.....because they would NOT have start
looking for the file. Even when the Immigration Liasion emailed her
contact, the contact acted like it was no big deal call back in 2
weeks and the file should be there and it would get approved. THEY
DIDN"T EVEN KNOW THE FILE WAS MISSING FOR 50 DAYS!!!!!!

Please don't stand by, being impatient is not the same as doing
everything you can to get your loved ones here!

GREETINGS - I FOUND YOUR MESSAGE AND EXPERIENCE INTERESTING AS I BELIEVE WE'RE
GOING THROUGH THE SAME THING.

WE FILED I-129F PETITION THROUGH NSC SEPT.13, 2002. FIRST TOLD 70-100 DAYS.
THEN JAN1, 2003 WERE TOLD 150-180. TO MAKE A LONG STORY SHORT, I'VE BEEN IN
CONSTANT CONTACT WITH BOTH CONGRESSMAN AND SENATOR'S OFFICE HERE IN MICHIGAN.
I LIVE IN ANN ARBOR. MY FIANCE IS FROM PARIS,FRANCE.

ON FEB. 14TH, MY CONGRESSMAN CALLS TO SAY OUR PETITION WENT TO AN "OFFICER" ON
FEB. 12TH. WE SHOULD HAVE APPROVAL IN ABOUT 2 WEEKS. TWO WEEKS COME AND GO
AND IN THE MEANTIME I'M SEEING MANY APPROVALS WITH RECEIPT DATES WAY AFTER
OURS. SO I CALL THE CONGRESSMAN.

THEY DO A LITTLE "CHECKING" AND FIND OUT THAT NSC DID A NAME CHECK ON MY
FIANCE AND FOUND OUT HE HAD LIVED IN BOSTON, MASS IN 1981. WE PROVIDED THAT
INFORMATION ON 129F PETITION. WE DIDN'T KNOW HIS A-NUMBER, HOWEVER. ANYWAY,
NSC HAD THAT NUMBER. THEY REQUESTED AND WERE NOW WAITING FOR HIS ALIEN FILE
CREATED BY THE BOSTON INS.

SO, HOW LONG NOW DOES THIS PART TAKE? AT WHAT POINT DO I START BADGERING MY
CONGRESSMAN AND/OR NSC. WE'VE BEEN WAITING NOW FOR 174 EXCRUTIATINGLY LONG
DAYS. WHEN I LOOK UP OR CALL ABOUT THE STATUS OF OUR PETITION THERE IS NO
MENTION OF A RFE OR THAT THEY ARE WAITING FOR ALIEN FILE. WOULD HAVE BEEN NICE
IF THEY COULD HAVE TOLD US THIS WAS WHAT WAS GOING ON.

IS THERE ANYWAY I COULD EXPEDITE THE NSC GETTING HIS FILE FROM BOSTON??????

tHANKS FOR LISTENING ME. I'M AM MY WITS END. I FEAR THIS APPROVAL THING IS
GOING TO GO WAY PAST THE 180 DAYS.

I would say keep bugging your Congressman if they respond....I have been waiting almost as long as you...and I was told by NSC my petition was with an officer also....since Feb 20.....that is plenty long enough....unfortunately...I have not gotten any response from my Congressman or Senator......I have called and left messages...emailed....I guess at least your state has political people who care....

goood luck....keep us posted....

Keep in contact with your congressman. It should not take very long
to find his A-file and forward it on to the service department. If an
officer just got your case Februray 14, then give it a week more max.
When did they send away for the A-file? From what I am told this
should take a maxium of 2 weeks to send/receive. Then as soon as they
receive your a-file then they can decided if they are going to approve
you that could take up to a month. But I would stay in touch with my
congressman and keep on them. If they can't find the A-file, they
won't care and they will sit around and do nothing. You have to make
sure that A-file gets to them quickly. That is what the past 55 days
of waiting has been about for our case, waiting for the damn a-file
and no one caring to look for it. It does not take this long to send
it. They have it somewhere and no one wanted to even concern
theirselves with finding it.

My advice: STAY ON TOP OF THEM!!!!! I am going to give mine a few
days and then make a friendly call to see what she has heard. There
is an investigation now, so soon, INSHA ALLAH (God willing) my husband
will be approved and onto the next step in this looonnngggg waiting
game!

Wow! Thanks so much for your great response. I was told that they - NSC -
requested my fiance's alien file on Feb. 27th.

I am tearing my hair out trying to figure this "a-file" thing out.

Even called a reputable lawyer today. First he said he'd never heard of
anything like this before. And to rub more salt in the wound he said since my
fiance was in Boston in 1981 his a-file was probably in a warehouse somewhere
and it could take up to 6 months for them to locate it!

My God, what is this all about?! He also said to call NSC, however it's
impossible to get through as the line is always busy. I tried to call my
congressman's office today but the women with whom i've been dealing was not in
for the day. This is a nightmare!!! What did I do to deserve this?

I'm a decent women who just wants to live happily ever after with her decent
Parisian man. I believe I've paid all my Ann Arbor parking tickets. Or maybe,
have I? Could this really be the problem? Is this what's really holding
things up under the guise of "searching" for a 1981alien file in Boston?

Are there other people out there who've had this same experience? How do you
know it only takes two weeks? As you can see, I'm loosing it. Especially as
I'm seeing all kinds of approvals from our same receipt date, Sept. 13, 2002,
and way past ours - all through Sept. and now into October. By the way, I'm
very happy for those guys - I really mean it! Congratulations!

OK, I'll calm down. Thanks for listening and helping.

Railway of 2000,

The number I called is 1 800 375 5283. It is very important to ask
for an "information officer" and that your case has gone beyound the
processing times. You are really concerened and need to talk to
someone. Some of the officers are great others SUCK. It is the luck
of the draw. Best of all is to contact your Senator and have the
"immigration liasion" call them for you because they have a contact
in the service center and can get even better information that way.
If you go to the web site of your senator you can print out the
permission for them to look into you case. Fill that out and write a
letter about your concerns and fax it to them. Then call to make sure
they recieved it. Call back in a few days to see who your case was
assigned to amd keep in contact with that person.

I hope this helps you. This process stinks but if you keep at it, it
will all pay off. Don't just sit back and be passive take an active
role. if your case is running late do sonmething!

Good luck! May we all get approved soon and on to the next phase of
this waiting saga!

Hi Candice - another great reply by you. Thanks. You're a real Pitbull! I
mean it as a compliment. The number you gave - 1-800-375-5283 - is this the
number to the NSC? If not what number is this to. Again, thanks for all your
help and generous support. Marian
