Already have my GC! WTF?

Default Already have my GC! WTF?

This is weird. It's a bit long but please bear with me. I arrived in
the US nearly 2 years ago, applied for AOS after getting married in
July 2002. While things were in train (August 2003) , we moved to
another state. From MD to NY.

I informed London, KY and the VSC of my change of address and even
CC'd Buffalo because we believed my file would end up there. However,
I think in the time between moving and settling in our new home (a few
weeks) the VSC had sent me some kind of notice. It was not forwarded
to our new address because it's govt stuff. Never could find out what
it was. There were numerous phone calls to the hotline and letters to
the VSC to try and sort it out. I even went to Buffalo Spetember 2003
to get an interim EAD and while there a staff person spoke to someone
from the VSC who said that my file was close to the interview stage
and they might decide to keep it there rather than transfer it to
Buffalo. I didn't care who had it as long as they knew I'd moved.

Then we had a letter around Oct 2003 saying the file was transferred
to Baltimore to schedule an interview. Ok, so I think it had been
transferred there while the move was happening and they were one step
behind. Another round of letters, including one to Baltimore and CC'd
to Buffalo and the VSC.

Then in November 2003 we get an NOA from Buffalo saying they had my
file now and to stay put, I'd hear from them soon for our AOS
interview. Hurray I think.

December 2003, I get a letter from Buffalo saying my Conditional
Permanent Residency was approved and the need for an interview had
been waived under section bla bla of the regulations. I like to think
maybe the person in Buffallo remembered my situation from when I went
for my interim EAD. I had a certain amount of time to pop in to the
ASC in Syracuse (didn't have to go to Buffalo) to get my fingerprints
and sign the form. Went there December, got my 2 year conditional
permenent residency. Hooray! methinks. A mere month or 2 later I got
the real thing in the mail. My Green Card, although it's not green. So
I think, good, I won't have to deal with these guys for another 18
months or so....

Now.... May this year, 5 months after getting my CPR, I get a letter
from the VSC saying that their request for evidence was ignored by me
and that my petition has been abandoned. I can file a motion to
reopen. WTF??? I HAVE MY GREEN CARD!

I believe this is a case of one hand not knowing what the other hand
is doing, i.e. Buffalo/Baltimore/VSC.

Do we have cause for concern here? I don't see how we can have our
petition cancelled when I've already got my bloody Green Card. We
intend to hire an immigration attorney.

Congratulations. I believe you are one of the first ones from NYS to experience this non-interview approval. Accept it for what it is and continue on with your life. Remember to apply to remove the conditions 90 days before its expiration.

Hit reply to soon. Send a copy of the green card, a copy of the approval letter and a letter explaining you do not know what VSC is talking about.

LOL no, it was incomplete. Didn't address your VSC issue about abandonment of your petition for residency.

Sounds like crossed wires here. Wonder if after you contact VSC you might think about contacting Buffalo (going in person if possible) and/or contacting your political rep for assistance.

Definitely would not travel without getting this straightened out.

I've just checked this ( I didn't realise there was a separate EAC
number with my letter from the VSC). Turns out this "denied petition"
was for my EAD application, which is no longer relevant because I have
a Green Card.

I still want to sort it out though.
