Hi,
they ask to my fiancee the last 3 years tax incomes but unfortunaly my fiancee is ok
for the 2 last tax incomes but for the 1998 one they don t make 125 per cent, is it
important ?

It "should" not be a problem. I think they look more at the most recent year and
current employment.

Does she have any assets she can use to make up the difference? When I sent my I-864
for my husband I had 2 of the 3 years under the limit - but I used my home as an
asset. He received his GC in April.
Another thought - If you are sending in your AOS forms - it could be a year or so
until your interview, perhaps by that time you will have another years tax return and
can submit a new Affidavit of Support at your interview. Depends on where you are
filing. When my husband and I went to our interview, we had 2 more years of tax
forms, both over the limit, which the agent DID look at.

i filed AOS for my alien spouse here in US. but now have to change jobs which will
put me under the 125% guideline for INS, our interview is in 2 weeks, will this
affect our eligability you think or are we ok? he is working here now and makes good

Past income is only part of the support. They are just as interested in your current income. I personally wouldn't worry about this unless you are only *just* making the required income now.
