Hi:

The INS came up with the form because the 1996 IIRAIRA legislation mandated it. That little piece of legislation was a poorly thought out mass of anti-alien reform provisions that made it into law in large part "under the radar" by being added at the last minute as a rider to the FY1997 budget legislation just before the 1996 election campaign. If you recall that the FY1994 and FY1995 budget fights actually caused the government to shut down operations in the fights between the Republican Party and Bill Clinton. And neither side wanted a repeat.

The IIRAIRA has a lot of polical content much of which has yet to settle out. One of the things in it was a reaction to revulsion to "aliens on welfare."

Even though she is conditional, she could get divorced and have the
conditions removed.
I do recall a post a while back (2 years?) where someone indicated the
divorce lawyer used the I-864 to get spousal support. It seems to be
clear on the current form. I don't know about prior forms.
For the record, it is only 125 percent, not 130 percent. Not much of a
help, but 5 percent is 5 percent.

I feel for Don too, but I don't think it is fare to blame certain
countries more than others. I am a woman from Easter Europe, and I am
not Russian.
Honestly, there are bitches out there in every country, so don't be
biased, please! I know many american guys who's american ex-wifes left
them with one or two kids of age 2-6, so don't think that eastern
Europe women are the worst that could happen to one! After all, Don
should have read the Afidavit of Support in a first place!
I belive he could get a divorce, or prove with INS, that the marrage
turned out not to be bona fide . Good luck to Don!

Hi Iliana:

The only thing I know for certain is that Donas' marriage did not work out. However, until I hear both sides of the story, I won't form an opinion as to why it didn't work. I feel that I don't have enough information.

I've been married for a long time and after two decades my better half and I often see things differently and it can get annoying to both of us.
