Hello!
My partner (USC) just received the letter from NVC with my LND and case numbers.
We've completed the DS-261 form and are waiting for that to process.
My questions relate to the next step.
Firstly, Im confused about which AoS form to file. Will it be the I-864 or the I-864EZ? The information stated on the travel.state.gov website says it would be the EZ one, but then I'm confused about the filing of it.
Secondly, Is the income requirement before tax or after? Im sure i read it somewhere but for the life of me i cant find that anymore.

The USC fills out the Affidavit of Support. He should look at the requirements for filing an I-864EZ to see if he qualifies. If he doesn't, then he'll do an I-864.
The income is based on gross income (pre-tax).

He can use the I-864EZ form if he is the sole financial sponsor and he qualifies using income alone. Both conditions must be met to use the EZ form. Otherwise, he uses the I-864.

As an aside, even if one is qualified to use the I-864EZ, it is still permissible to use the standard I-864.
