Default Affidavit of Support

Hi,

I would like to know something more about this document. I guess this
one should be used if you want to invite someone to come and visit
you. How important is this document, and is it in any way obligated to
issuer? What happens if the people who use this affidavit come to US
and after that overstayed there visa?

Can it be used by green card holders or only by US citizen? How many
times you can give this document?

What about letter of invitation? Any sample letter?

I think I need to add that to my FAQ page. If the person you are inviting
will come as a tourist, it is usually NOT a good idea to send an affidavit
of support unless the consulate insists on one (some consulates do) or the
person is very poor.

The problem with an affidavit of support is that it is evidence of a tie
to the United States, and can contribute to a visa denial for immigration
intent.

This document can be critical if the consulate requires it (I hear that
consulates in India usually require it). The document can also be critical
if the person does not have enough money to support himself in the US - in
that case, the visa would be denied without the I-134 (affidavit of
support).

It does obligate the signer; in fact, that's the whole point of the
affidavit of support. This obligation persists until the beneficiary
leaves the USA.

I'm actually not sure, but I believe you remain obligated for up to five
years.

Any US resident, even long-term non-immigrants, can fill it out.

As many times as you like and your income allows (in other words, if you
sign I-134s for six people and have a family of four yourself, you need
enough income for ten people).

The invitation is actually usually more important than the affidavit of
support. It should outline what the tourist is planning to do in the US,
and who will pay for it. For instance, a wedding invitation would be good
if the purpose is somebody's wedding. Else, a letter that describes "We
will be going to Yellowstone in my RV" if that is the plan. And so on.
