Affidavit of Support
Hi guys!
I have a question about form I-864. I will be using my husband income to immigrate my parents but my husband put a big chunk of money for his pension last year. So on his W2 it says $15 000 for wages which puts us under the minimum. But if we add the $4000 he put aside for his pension we DO have enough. Do I need to look for another financial sponsor or does the INS take in consideration the pension money as a part of anual income? Any answer will be helpful!

The key figure for INS is not the income in the last year, although the last
year's income is supporting evidence of what next year's income may be. The
crucial figure is the potential income for the next year. This can be shown
by a letter from the employer confirming the current salary.
If the $4000 was a voluntary contribution toward a retirement fund, for
example a 401(k), your husband should stop putting aside the money for the
pension, and bring in evidence that he did this so that his income is now
high enough. (He can reverse this after you get the green card.) If the
$4000 is something that the employer puts aside for everyone, and cannot
give to your husband as income, then you will need the joint sponsor.
