Advance Parole

Advance Parole
Am i right in thinking that my children will not need advance parole to come back to visit their Dad in the summer (that is assuming we make it out by then!!!)
We are K1/2 applicants so we should have valid immigrant visas ... advance parole is just for K3/4 applicants . I am I right on this or do I have it totally messed up!!!?

Advance Parole is also for K-1 applicants Ginny.

Advance Parole is also for K-1 applicants Ginny.

They will need Advance Parole if they do not have their I-551 stamps or
green cards. Once they are permanent residents (have stamp or gc),
conditional or not, then AP would no longer be needed.

a K1/K2 is a non immigrant single entry visa. If you (or the kids) wish to leave the US after entering on your K visas, you have to wait until you get married and file for your AOS, then you can apply for advance parole to leave the country.
As a K1/K2 you cannot file for AP without filing the AOS.
If you left before filing the AOS (and AP), you would no longer have any status and would have to re-apply for a visa to enter the US again.

oh heck... now i'm truly confused...
For a start we are married... we have been married nearly 5 years. I knew we'd have to wait for the permanent green card to arrive but i thought the visa in the passports would cover them... not so huh?
Oh god... i'll go see if i can find this new bit of paper... where and when does it get filed.. and how much money is this one going to cost us!

I've looked up this info on the BCIS site and still can't see that we need it... we won't be applying for adjustment of status.. we are already an established marriage so we'll be going in as immigrants not non immigrants... We are all in the UK together at the moment. I'm beginning to think i've done the whole thing wrong... was it even a K1 visa I applied for ???!
