Default Adopted child

I am registered nurse in the Phils. I will definitely seek employmnet in
the US after I pass the NCLEX. I have a son who was given to me a day
after he was born. The mother disappeared and can no longer be located.
My fiance at that time registerd the child as our own so what we have
now is a simulated birth certificate. I'm now on the process of
rectifying the said birth certificate simultaneous with adopting the
child. The decision/court order will be out in 6 months. Will the
simulation of birth certificate in anyway affect the issuance of
immigrant visa to me? Granting that an IV be approved, will I be able
to bring my son with me or do I have to comply with two yrs legal custdy
requirement? Based on the facts of my case, my son is under the Orphan
category. I am still single.

Please help. I am desperate.

Your case is so specialized, I do not think you will find anyone here who can quote you chapter and verse (and who knows, maybe your situation is unique)? You need specialist advice - go see an immigration lawyer who has experience of custody cases. There is a lot of guessing, 2nd hand knowledge and just plain BS on here, you will end up more confused than you did when you posted the question.
