About to leave country!! What to do?
Hi everyone,
I have posted a few times recently about my husband's RFE from the
VSC for I 751. I sent that out about a month ago and am still waiting
to hear back. I know it can take a while so I am trying to be patient.
The only problem in that recently I accepted a job which will be
sending us to Zambia. I am worried that we will not get any kind of
answer before we leave. What will happen if that does happen? I know
eventually we will get some kind of answer but if we are out of the
country what can we do? I remember on the original I 751 application it
had instructions for if you are out of the country so I assume it is
possible to go through this process ( or at least part of it) while
being out of the country. We are leaving in about a month. Any
suggestions for what to do in the mean time? If we make an infopass
appointment, can they give us a stamp to extend the extension? I just
don't want him to be in a situation where he can't reenter the country.

Make sure that USCIS has an address at which someone can receive your
mail.
If you expect to be gone for over 6 months, you may consider to apply
for a reentry permit (form I-131)

We will be gone for a year. Do you mean give them the address of a
family member who can get our mail? The organization that I will be
working for will forward mail that is sent to them in the US, will that
do or does it have to be a residence?
So he can't get a stamp if we go into the local office? Can we apply
for the I-131 at the consulate in Zambia?

We will be gone for a year. Do you mean give them the address of a
family member who can get our mail? The organization that I will be

If you think that that forwarding method is reliable enough, you can go
for it.
I think that you can apply for a reentry permit the USCIS overseas
office which juridiction covers Zambia, but I think that you'll get a
better chance of approval by applying in the US with a US address.
You may be able to get a stamp thru infopass. However the stamp does
not protect you (the reentry permit does) against be accused of having
abandonned your permanent residence when you come back.

I think that you can apply for a reentry permit the USCIS overseas

It might be OK to apply for it in the USA and have it forwarded to them with all the rest of their mail. The OP should check on what the reentry permit entails.

AFAIK, it's okay as long as they APPLY before the leave (unlike AP).
At least that's what our lawyer told us.

You don't give the nature of the job in Zambia -- look into the possiblity of immediate naturalization under 319(b) of the Immigration & Nationality Act. If eligible, that will speed up the I-751.

I got a fellowship with Catholic Relief Services to work on an HIV/AIDS
project. Does that make him qualify for immediate naturalization?
Also I am still unclear about this reentry permit. Do we need to
apply before we go and have it forwarded to us by the post office?
Will they deliver to a different address?
I guess what I need to know is how can I be as sure as possible that
he will be able to reenter the US?
I'm sorry about the repetition, but sometimes there are so many
different answers that I need as much clarification as possible.

Catholic Relief Services headquarters is in Baltimore and they will
forward mail to me in Zambia. Any mail that needs to be sent to us will
be sent to them first.
Does that make applying any easier?

Yes, apply for it before you leave and if at all possible have it sent to you c/o of their address. Explain on the I-131 the nature of the reason why you need the re-entry permit and that CRS will be your address of record.
