Hello,

I know it's been a while since I posted my question regarding the 90-day EAD I was issued at the Hartford Immigration Office - sorry I took so long to post this explanation.

We returned to the Immigration Office last week and spoke to the receptionist. She immediately said that the 3-month EAD is standard for people coming into the US on a K-Visa. Apparently it is a temporary EAD to cover the 3-month period you have in which to get married. The fact that we got married two weeks after my arrival here, then submitted the AOS and EAD applications together doesn't make any difference - the first EAD on a K-Visa is only for 90-days.

Anyway, we submitted the renewal that day, and the lady assured us that I will get an appointment to have the EAD renewed within the 3-month period.

I'm not sure that's the real reason; they may have just told you that to get over it.

Did you apply under (a)(6) or (c)(9) for that first EAD (the provision is printed on the card also)?

If (a)(6), it should have been set to expire with the expiration of the K1 status (less than 3 months), or denied entirely if K1 admission had already expired.

If (c)(9), it was based on an adjustment application and should have been one year, but as the (c) is a discretionary category, they can give it any length of time they want up to 1 year.

Dawn,
My husband should be getting his EAD from Hartford as well...we haven't heard anything yet. The receipt date is for feb 23,2004 so it's been a little over a month. I'm afraid it's going to take forever to get his card.
Do you have a timeline posted anywhere?

Hi Rukhie and CP,

CP - I filed under (a)(6). I don't know if the explanation was entirely right, I was just relieved to be told that this was 'standard procedure' and nothing to worry about. I came into the US on a K1 Visa on October 12th 2003, and the Officer at the airport wrote 'K1 until Jan 11th 2004', so I assumed that was the date by which I had to get married and submit my EAD/AOS applications.

Rukhie - We don't have our timeline posted, sorry. I originally sent my EAD and AOS applications off to Vermont in early December 03. They returned them stating I had to go to the Hartford Office and submit them in person, which I did on December 22nd 2003. They gave me an appointment letter that day to collect my card on March 22nd 2004.

Hope this info is useful.

So as i understand can i still go for my 90 days EAD at the Boston office?We submitted already the AOS a couple day ago.Any help appreciated.

Big relief; the 3 months is your own fault.

(a)(6) is for getting an EAD *before* filing for AOS and supposed to expire with I94. I guess they actually goofed *in your favor* by approving it after I94 expired and in any case by giving you a full 3 months.

When filing for AOS, should use (c)(9) and normally will get 1 year validity.

Well i m still very confused about the whole EAD,and i still don t know if can file the 90 days EAD immediately after i submitted already the EAD with the AOS (under c9).

I'm a little confused by your confusion.

90 days, immediately?

My wife and I refiled AOS/485 on April 2. She'll be able to apply for an
interim EAD after 91 days, somewhere at the beginning of July.

Okay i m talking about the 90 days covered whenever you enter the US under the K1 visa.So i don t know,since i m still under these 90 days if i m still eligible to go for the EAD,but we also started to file the AOS since we got married already,so i know that we can can go for the inetrim EAD at day 91,but can i also go now for that EAD covering the 90 days under the fiance visa?
