** G-325A Question for Sponsor of a spouse **
1.) If a US Citizen sponsors a foreign spouse via I-485 package. I
believe both people (sponsor & spouse) need to fill out form G-325A
correct?
2.) What would the SPONSOR put as their reason for the following
question:
"THIS FORM IS SUBMITTED IN CONNECTION WITH APPLICATION FOR:"
NATURALIZATION
STATUS AS PERMANENT RESIDENT
OTHER (SPECIFY):
I assume that both G-325A forms should select "STATUS AS PERMANENT
RESIDENT" ? Would this be the case even though the application is
for conditional residency of the spouse? Would this be the correct
answer for both G-325A forms for both the SPONSOR and the SPOUSE?

Based on admission as the fiance(e) of a U.S. citzen and subsequent marriage to that citizen. You may apply to adjust status if you were admitted to the U.S. as the K1 fiance(e) of a U.S. citizen and you married that citizen within 90 days of your entry.
This means that you, as the spouse of a USC, fill in the I-485 not the USC.
Also, you are the only one required to submit the G-325A, the only form the USC is responsible for filling out is the I-864.
You are correct though, in saying that you should tick the box for 'status as permanent resident'.

No.. the spouse was not admitted as a K1 fiance of a US Citizen.
Instead, the spouse had a toursit B-2 Visa and has been here in the
US. They became illegal as they overstayed their visa. I got married
to them since then and now am applying for their conditional residency
through I-485. Do we both still need to do G-325A's and do I check
"Status as Permanent Resident" ?

To get a better handle on things -- you are putting in a "combined" I-130/485 package. The instructions will then make more sense.
Also, remember that the G-325A requirement from the citizen spouse was imposed long after the form was drafted.
So, on YOUR G-325A, I would check the "other" box and put in "I-130." However, this is not something to lose sleep over. That box is not a major box.
For your spouse, you stated she is applying for conditional residence. So, of course, you check the box "permanent residence." Since you stated she is applying for permanent residence, why would you question what box to check.
In any case, I have mentioned elsewhere in the past that the G-325A simply need be fairly accurate and errors are easily forgiven unless they tend to lead CIS astray.
