I think so, and if this is the case it would appear that I have had one of my pictures stolen and the rights to use it sold to London Drugs.

No-one has ever asked me if they could use it. :mad:

Having dutifully ploughed through the Canadian copyright act and the corporate history of London Drugs, a corporation that has its agreements governed by BC law, I now see that Steve does have a case. How useful it is to have a case in a land of expensive lawyers who don't work on a contingency basis I dunno but Steve does seem to have been violated in Canada.

I would like to know who this site or organization is and who they bought the image off. Whoever they bought it off is most likely the one who lifted it off the pbase site.

This image was placed on the pbase site very early on in my journey into digital photography and I was unaware of both copyright law and exif information at the time.

I still have the original image on my hard drive, I found it again last night so I can definitely prove it is my image.

On the one hand I feel quite chuffed that someone thought enough of the image to use it professionally and on the other hand I'm p*ssed off that someone is possibly making money from my photograph.

Further to this, I just did a Google image search and found there is another website using this photo. :mad:

Someone called CARDS-Plus Marketing here in Calgary, which would lead credence to my supposition that the the right to use the photo is being sold by some company somewhere.

I tried to phone CARDS-Plus Marketing but their phone has been disconnected. So, dead end there.

I did also email the graphic design company that did the website but have not heard back from them yet.

Hey Steve, tell them, 'carry on using the pictures, send me money'. Who knows you may get a free camera and an apology. On the other hand they may not. But if you don't ask!

Thats horrible! Sounds like they may have been fly by nights though if their phone is disconected. It just shows how difficult it is to protect peoples privacy on the internet doesn't it? :frown:

Steve - found the following snippet from their legal page - you need to set them straight on it......


"All material contained on the Site including the content, site design, text, graphics, and the selection and arrangement thereof are the copyright of London Drugs (unless otherwise expressly stated)."

The graphics on the site for Cards Plus is done by a company called "Round The Bend Wizards". They are based in Texas!

I received a phone call from London Drugs today with many apologies and an offer to remove the offending image. They do not in any way dispute the fact that the image is mine.

I told them to leave there as I don't object that strenuously and if they are willing to offer some sort of recompense then we can all be happy.

They said they thought they had bought the rights to use the image from a clip art website about a year and a half ago. But they can no longer find that image on the clip art website. So they would like to dig a little deeper to see what they can find. If they find who they bought the rights from they will definitely let me know and I can pursue it with the offending web site.

They said that they were quite amenable to maybe working out an arrangement with me perhaps some free printing or some such thing. The fellow I spoke with said he could not make that decision but did not see that as being a problem.

So it appears we can work it out and all be happy with the result. :):)
