A landlord may charge a service fee charged by the bank if a tenant's cheque is returned. If the tenancy agreement includes a term that allows a landlord to charge an additional administrative fee for the return of a tenant's cheque, above the service fee charged by the bank, the administrative fee cannot exceed $25.00.

One because I enquired at the bank and they commonly don't. Two because I specifically asked on two occasions what the bank charge was and she was all evasive, citing the contract. So I suspect there is no fee. Thank you

To me the act says a landlord can charge the tenant the banks fee + up to $25 admin fee.

And if charged nil? I have asked multiple times for the fee amount, pretty sure it's nil

Why not go online to the banks website and check what they charge for NSF?

This happened to me recently, & I was absolutely mortified. My rental agreement (not BC) states the penalty = bank charge + admin fees.

I went to LL ASAP to put the situation right, & she waived admin fee. The bank charge was 45$, which I paid. I'd be surprised if the bank in your case really doesn't charge a fee for NSF (if so, please tell us which one!!).

It seems, after a bit of research, that some banks charge rather-to-a-lot less than 45$ for an NSF cheque, depending on what kind of account one holds.

So Dishwashing would be right to request proof of bank charges, IMO. Of course this is unlikely to endear him to his LL.

You messed up so pay the money is my opinion. You seem to think that as the LL has several lets that you shouldn't pay. I bet their experience is that levying a charge focuses the tenants mind on paying and makes them less likely to be late payers in the future.

Id say thats very unlike any canadian bank I know of!

The regs say $25 in addition to any fees incurred (in Ontario its $20 in addition to any fees incurred, but thats BC for you... more expensive)

Pay the $60, its worth it not to foul up your references should you need them.

It is not unknown for my tenant's rent cheque to bounce. When it does they pay me the rent + $25.00. I have never asked for the $25.00 but they add it on in any case and I don't refuse. Their bank charges them an NSF fee. My bank does not charge me anything. This may be because they think I am a super awesome customer or it may be their policy. I don't see any benefit to me in asking. This is ScotiaBank.
