Air Canada agent right to deny boarding over expired passport, court rules

Went to St Lucia on AC while his passport was still valid, but it expired in St Lucia and AC refused to allow him back on the flight to return to Canada.

Any sympathy with him? I certainly don't.

There are all kinds of warnings about not leaving on a trip with less than 6 months left on your passport.

In fact, I thought an airline could refuse you if your passport was within 6 months of expiry?

I wouldn't want to test the theory, but I had heard that generally airlines will allow you to fly to your home country (the country that issued the passport) on an expired passport.

It does seem a little odd that a Canadian airline would deny a Canadian citizen a flight to their home country, even if they do have an expired passport. And arguably more odd that a Canadian court would rule that a Canadian citizen doesn't have an inviolable right to enter Canada.

The airline just has to know that you have the right documents to be accepted by the destination country. Not all countries insist on the 6 months validity.

I thought it was only UK passport that had that '6 months left' thing, not Canadian - but not sure, so happy to be corrected!

The ‘six months thing’ depends on the policy of the country you wish to entry, not the passport you hold.

And no, no sympathy. The question isn’t of a Canadian citizen being refused entry to Canada - he was in St Lucia - but of someone trying to board a flight in breach of the airline’s own conditions of travel and applicable laws governing international travel.

From the AC website

Passports

A valid passport is required for travel to, from and via most countries, including for return travel to Canada. If you do not have a valid passport, we strongly recommend that you apply for one well in advance of travel.

If getting to a POE on an expired Canadian passport and CBSA believes it is you then they would allow entry as a Canadian citizen has a right of entry. The refusal to board is strictly Air Canada's.
