Default Land Registry

Just a tip for all of you about to sell up, if your land is not registered with the Land Registry it may well be worth your while putting the wheels in motion now. Unfortunately we have hit problems with this. Our neighbour sold their property last year and somehow the Land Registry has registered the boundary between us without any reference to us at all and, of course, it is wrong!!!! about 40' wrong. (we have over an acre of land)

We understand that the Land Registry is supposed to contact all parties concerned and this was never done in our case. They are trying to contact the person who did the job last year to find out what went wrong. We now have the hold up of not being able to exchange contracts until this is all sorted out and of course perhaps even losing our buyer. I am feeling absolutely sick to the stomach and do not know how many more knock backs I can take, everything just seems to be going wrong and feel like we will never get there. :curse:

How absolutely infuriating! Something you knew nothing about that comes out of the woodwork to knock you down!

Good luck with sorting it out. Any idea how long it will take?

Hopefully it won't cost you money!!

My husband is absolutely furious. Our solicitor seems to have been dragging his feet which obviously costs money and now this comes around. I think the Land Registry ought to be liable for any additional costs incurred on this one!

But you must be realistic. When did anyone in authority ever take responsibility for their mistakes?

Well OH spoke to them yesterday and they are supposed to be getting the man who did the surveying of the boundary to contact us because according to them they should have contacted us to make sure we agreed with the boundary siting. This didnt happen we had no contact from them whatsoever so I think they ought to be paying for correcting their mistake, we will see.

Hopefully the surveyor will be in touch today......unfortunately I wouldn't hold my breath! You never know - perhaps you will be pleasantly surprised!

We have had problems with a lease - the only people who will end up paying is ourselves! What a riip off!!!!

Well keep your fingers crossed, we have the man from the Land Registry coming out today! Speaking to the Weymouth office who are responsible for this area he said it would probably take about 3 to four months to sort out! Totally unacceptable as it is their error, so we managed to get a copy of our deeds etc down to the Weymouth office Monday late afternoon and they arranged for someone to come to see us this morning, hows that for getting your finger out. Do it yourself, bypass your solicitor!!! Although not admitting anything the feeling is that they know they have made a b... cockup and hopefully we will get it sorted out before we lose our buyer.

They say moving is one of the top ten most stressful events in life and at the moment I would put it right at the top!

Well Land Registry's rep came yesterday and has to admit that something went seriously wrong with the registering of our boundary. Should get a letter from them saying as much so perhaps we can then proceed with exchanging contracts, and they will also be arranging with the Ordnance Survey to come out and draw the correct lines!!! I have sure got a few more lines I can tell you, ageing by the day with all the stress
