Was I really THAT bad in a past life?
 
Driving past my mess of a house tonight, we spy a well drilling company drilling a well on our land. A well we have not asked them to drill. Turns out the business next door asked them to do it. Honestly.

So spoke to the business owner and asked him to show me the papers that prove it is his land. He told me to just trust him that it just is! :eek:

If I was certain it was my land, I'd have let him finish, and then had the benefit of the well :)

Amy, I think you should write a book about your experiences with your house. I realize that it is certainly not amusing to you what's been going on , but the readers would enjoy a humorous account of what can go wrong with a "fixer-upper"
(we have been in a very similar situation with our old house and can somehow relate to your troubles)

That could end up being an expensive gamble.

If the OP is sure it is her land, she should ask the company doing the drilling to show their legal authority to be able to do so.

I did ask the drilling man was he shown proof it was the man's land and his answer was "I am not going to say to people "Your lying - this isn't your land" :eek:!! I would have thought it was standard practice to be shown boundry lines etc...obviously not!

He is digging out his paperwork and will fax me a copy of his proof over the weekend...lol

You might want to get you own survey done and get the property lines marked out to be sure. We had this with a local farmer, tried to convince us our trees were on his property and he wanted to chop them down. Fortunately we found the property markers.

Yes that is our next step I think once we have seen his proof. We can find markers for one side of the property boundary but none for the rest. Thanks

It's most unfortunate and I trust everything is resolved in your favour. Obviously your Offer to Purchase the property did not include the previous owned providing you with an up-to-date survey. This should be a warning to everyone purchasing a property to insist on a survey. I'm surprised your lender (if there was one) did not insist on one and instruct your solicitor accordingly.

We kept a diary of everything that happened to us it reads like a comedy not at the time though :( hope you find the paper work and its in your favour hun ) :wub:

Nope - they are written as follows:

Start at the Northeast corner of Highway 7. Walk 52 paces north to Miss so and so's land..:eek:

We asked and asked our realtor if this was really what we should have had and he said yes. We found out after we could have asked the sellers to provide a boundary map. However using the crappy walk this and then that way thing, the well they are drilling is on our land.

We will see next week. We have always said we would get a boundary plan done, this probably just means it get's brought forward a bit!
