Buyers are allowed reasonable access to the property once all conditions on the contract are lifted. It is a standard clause in most real estate transactions in Canada. And, in my experience, standard practice.
If the buyer goes into to the property, as above, and finds something 'wrong', too bad for the buyer. As to the original post, the seller did nothing wrong, and the buyer could hardly expect to have free access after they had already tried to get out of the contract. We are going ahead with the purchase and no point were we threatening to break the contract as we happen to be people of our word. All we did was ask if they would consider walking away with 5K in return to let us walk from the deal...... we never threatened or anything else and after 6 days and an extremely brisk housing market I don't think it was that unreasonable to ask....
My lawayer said that we should aim to flip the house back out as the market here is so brisk, and we would much rather do that than let another family down..... However, can I just make one point...... I thought on here it was supposed to be a community, I honestly thought we were people all in the same boat..... It seems to me that there are certain users of the site who enjoy taking an agressive and belittling tone at every opportunity with snide comments and generally nasty attitudes. Not just to me but to many other users and on many other threads too. It makes me wonder, they are often people who post frequently and appear to take enjoyment at putting others down. It makes me wonder just how well they are getting on in their new lives? Or maybe wherever they go they just can't help but spread a little unhappiness? It's one thing to disagree with people and point out where they may, in your opinion have gone wrong, but I think in general there seems to be certain individuals who really go out of their way to make people feel awful. And when you are alone in a new country trying to figure things out you can do without that. Especially from one of the few places that you can go to which gives a bit of support... Thanks for your support (mostly) guys and I am now off to look at the new house, which will only be my second time to do so. For the few of you out there who knows it's you I am talking about, maybe you should take stock at just how you come across to people both on and off the internet. Just a thought. All the real estate that I have ever purchased in Canada (BC and AB) and anyone else I know that buys real estate have included this clause as it has been important to have reasonable access to get measurements, estimates for renos, etc... and there's no real point in doing that if the deal is still in wishy-washy phase (ie, the conditions for sale not being lifted). I have never had a seller have a problem with this clause, ever. To me, this is very much standard practice. I'm not suggesting buying property in Canada is like buying in England. I'm well aware of the differences. |

This place works best when we learn from each others experiences, so lets hope someone else can avoid this situation as a result of this. |

Hi Mrs M,
If you REALLY don't want the house, but you think someone else might, you can assign the contract. This means that you are selling the house to someone before completion - assuming you have time before your completion to do this. This is a common practice here in BC for sales of pre-construction condo's - where they are flipped before they are built - sometimes more than once. Your realtor should be able to tell you if there's any likelihood of this working in your circumstances. Otherwise you will be buying small items of furniture by the sound of it - the same as Vancouver condo buyers have to do :D Good luck whichever way you go on this. Warmly, Frank

But this advantage can easily be reversed by the use of appropriate conditions written in, in favor of the Buyer.:thumbsup: For instance a condition the could have been written in for the benefit of the OP would be something like; " Subject to the viewing and subsequent approval of Mrs Muggle by date, time" It would then be up to the Seller whether they accepted/amended/rejected that condition. But I can not stress enough the importance when buying a home in Canada to get your own representation, a Good Realtor and a Good Lawyer are all you need, and really there are far more good ones out there than bad ones. |
