Question I-130 Petition

Hi.

In 1996, a travel agency filed an I-130 Petition for my whole family. My wife is a permanent resident. The travel agency filed one petition and told us that he included our two children in the petition also. The petition was approved on 10/17/1996 and my priority date (07/17/1996) became current and I have already adjusted my status. My children are still in China now. I want to know if my children were included in the petition?

After I adjusted my status, we were advised by a friend to file separate petitions for our two children and ask INS if they could set their priority date to the one I had. We filed the petitions in July, 2002. I have wrote several letters to INS asking them to give my children the same priority date as me because my daughter will turn 21 in less than two months, but they have not replied to me at all.

1. Will my children be able to get the same priority date as I had?

2. My daughter will turn 21 in late December. Will she age out or does the CSPA include her?

3. Is there anything I can do to get my children here as soon as possible without having to wait 5-6 years for the priority date to be current, if they are unable to get the same priority date as me?

Please help me.

Thank you very much for your help.
