According to the Times today the French parliament has past legislation that permits Brits with homes in France but not resident to spend their 180 days as they wish. In other words they are not obliged to exit after ninety days. It would be nice to think the Italians might do similarly....

This was passed in the upper house a couple of weeks ago but has not yet gone to a full vote in the lower house but in any event Macron has said that he will block it as it does not comply with Schengen rules .In any event the EU would over rule the whole legislation as it would cause chaos especially with the introduction of EES

As this move would involve the granting of a visa by the national government concerned be it France, Spain or Italy I fail to see how it could be overruled by the EU. How Macron could say that it does not comply with the Schengen rules is not clear to me..

I guess if it only applies to UK nationals to then the EU might consider it discriminatory, maybe going as far as saying it should apply to all 3rd country home owners, or not at all.

As for Macron and Schengen, he is right, the rules apply, in one way, for EU nationals and in another (90/180) for 3rd country natipnals.

The idea, whatever it's motivation, makes a mockery of the present system. While one can sympathise with home owners whose use is now restricted (assuming they did (were able) to vote remain) the fact is that the UK voted for Brexit and as somebody said "Brexit is Brexit" and the UK population has to accept it.

I haven't seen any evidence of President Macron making the statement claimed but in any case, the common visa policy relates to short stays only.

This would clearly be a provision outside of that and therefore entirely down to the scope of national visa rules. I don't think there's anything in Community Law which obliges member states to treat all non EU citizens identically in their national territories.

I read about Macron blocking it in The Independent ,and it relates to short stays in excess of 90/180 for holiday home owners without the need for a Visa,but of course they can already apply for a visa to stay longer.However staying longer than 6 months then opens up another can of worms such as taxation issues health care and car insurance/registration.
Then of course there will be a small number of individuals who claim that they are holiday homers but in reality will be living more or less full time in France without making their proper contributions etc

As predicted, the French constitution council have thrown out the supposed special visa waiver for British homeowners in France.

There is no appeal procedure so it's the end of the road.
