Withdrawing Sponsorship
Hi,
I am wondering if anyone knows more about the consequences of
withdrawing sponsorship from a Permnanent Resident visa holder.
I (AU citizen) sponsored my husband (US citizen) and he is in Australia
on a permanent resident sub class 100 spouse visa and has been here for
just over a year. We've been married 6 yrs and have a child together.
Now the marriage is not working and we want to separate. I called
Immigration and they told me to notify them of the separation and
withdraw my sponsorship.
My concern is that during my husbands application, Immigration
requested a declaration from me stating I would support my husband for
the first 2 years. It was not an official Affidavit of Support form,
just a written statement (same thing I suppose). Now if we separate am
I still financially responsible for him? This would be impossible for
me if he got sick or lost his job. It's also impossible to stay in a
bad marriage.
I am wondering if Immigration looks at each case or would this be a cut
and dry thing.

Dear Cas,
You can't withdraw your sponsorship when he has PR (ie the subclass 100 visa). Equally, I don't think anyone will ever be able to enforce the sponsorship obligations against you.
On the other hand, if anyone gave him an assurance of support then if by some miracle he was able to draw on Centrelink for benefits the AoS giver would be liable.
Hope that your child doesn't suffer through this.
