Had it been in countries like US straight away would have served the purpose i.e. child with that country passport ...However in Australia parents need to get the appropriate visa on their parents country passport....well good thought

They will need to add the child to their student visa. The child is a temporary resident.

Hi All,
Yes, this is right. Unless one of the parents has a permanent visa or is an Australian citizen, the child will not automatically be an Australian citizen.
The status of babies born in Australia depends on what the visa status is of their parents at the time they are born. For instance, if the baby is not a citizen, but their parent has a visa, under s78 of the Migration Act the baby is deemed to have been granted at birth the same visa as its parents.
But, if the parents' visa application is not finalised the baby might need to be joined to the application and pass the time of decision visa criteria for the particular visa subclass.
It's so cute seeing the little babies' passports. And, of course, if you're not sure what to do find a reputable migration agent to help. Fees should be low for this kind of work.
Regards,

![Question](https://britishexpats.com/forum/images/icons/icon5.gif)
Hi
We're planning another baby so just to be clear...
If the baby is born before the visa (175) is granted then we can add him/her to the application.
If the baby is born after its been granted and we've moved to Australia then the normal rules apply for a baby born in Australia.
But what happens if our baby is born after we have been granted the 175 visa but before we move to australia ? (a real possibility)..
Any thoughts ? All replies appreciated.
Thanks
