VISA REFUSED
our youngest son 6 has 10 hours per week one to one in his school. this is the reason for the refusal. he has no medical problems, no statement label ( ADHD, AUTISTIC). He is just slower than the other kids, around 12 - 18 months behind.
the actual wording was: he does not meet public interest criterion 4005.
his ongoing educational support will be a significant cost to the australian community.
when we started this journey the main reasons to move to aus was for the boys. we have 2 extremely sporty kids, they would have loved the aussie way of schooling and life. i have family in education in nsw they can not understand the decision. we were there this time last year, looking forward to the big change some time next year. i was actually looking at work which was paying two thirds less than i earn now.
so there you have it.
people who have kids with any needs. please look into the visa you are applying, as another classification might be better. we were as far as our medicals when it got flaged up as my 6 year old could not read the eye chart.

I am really sorry to hear your bad news. I would strongly recomend that you seek the advice of someone like george Lombard who I believe has experience in dealing with these issues. Don't give up without at least getting some professional advice. You could try sending a pm to a couple of the agents such as George & Alan Collett who post on the forum.
I do know that there are other parents with similar difficulties so I hope that you will get some further advice.

yes we were using an agent, wont say who. they would not have got my recommendation even if we got the visa. very poor communication, they only wrote a 2 line email with the attachment from the case officer. no phone call to say they were sorry or give us any advise of how to proceed if at all.
we dont want to get our hopes up again only to be side swiped again. its a gut wrenching feeling knowing the life you had planned for kids wont come to fruition.

it seems to me they ask for more reports on my son with the decision already made.

This is so sad, I'm sorry to hear your bad news. I really don't understand it he's only 6, My middle son was behind at school and got extra help when he was young and by the time he left school he was in the top set for everything, so dont know how they come to that decision.:curse:

It sounds to me as though you have received an invitation to provide further medical evidence, not a refusal. We're dealing with two cases at the moment involving educational delay and the medicals, so happy to help if you would like to email me the details.

it does sound as this is happening more, as there are quite a few members on here who have children that were statemented in the UK for one reason or another (ADHD, Autism etc), and yet are over here with their visa.
i dont the answer, sorry, but i wish you all the best. it does some harsh, especially as a precedent has already been set, and lots of visas have been granted where their children have learning difficulties (with a label!!). have they changed their criteria then George, seeing as this seems to be happening now?

Actually I think they've been relatively slack on UK applicants recently and now just moving the goalposts back into position, since I had clients 10 years ago facing problems with ADHD and there are many appeals on these issues if you look at the MRT database. But given that so many of these conditions are questsions of degree there's normally some flexibility if you engage on the issues.
